Cable, Cable Ramp & Accessory Rental Agreement
These Terms of Service ("Agreement") govern your access to and use of all rental products and services provided by Cable Fleet ("Company," "we," "us," or "our"). By completing a rental order, signing a rental agreement, or taking possession of any equipment, you ("Customer," "Renter," or "you") agree to be legally bound by these Terms in their entirety.
Cable Fleet is a Massachusetts-based equipment rental company specializing in cables, cable ramps, and cable accessories. All rentals are subject to Massachusetts law.
1. Rental Eligibility
To rent equipment from Cable Fleet, you must meet all of the following requirements:
- Be at least 18 years of age.
- Provide a valid, government-issued photo identification.
- Provide a valid credit or debit card for deposit and payment authorization.
- Agree to and sign this Agreement prior to or at the time of equipment pickup or delivery.
- For business accounts: provide a valid business name, address, and authorized representative.
Cable Fleet reserves the right to refuse rental service to any individual or entity at its sole discretion, including but not limited to customers with a history of damaged, lost, or late returns.
2. Rental Period & Extensions
The rental period begins at the time the equipment is made available to you (whether by pickup or delivery) and ends at the time of return, as specified in your rental order.
- Rental periods are defined at the time of booking (daily, weekly, or monthly).
- Extensions must be requested at least 24 hours before the scheduled return date.
- Extensions are subject to equipment availability and may be denied if the equipment is reserved by another customer.
- Unauthorized possession of equipment beyond the return date constitutes a "Late Return" and is subject to late fees as described in Section 6.
- Failure to return equipment within 10 days of the scheduled return date may be reported as theft to applicable law enforcement authorities.
3. Equipment & Condition
3.1 Equipment Categories
Cable Fleet rents the following categories of equipment:
- Cables — Power and data cables in various lengths and configurations; extension cables and multi-conductor cables; audio/visual cables and specialty cables.
- Cable Ramps — Single- and multi-channel rubber and polyurethane cable ramps; heavy-duty ramps rated for vehicle traffic; modular and portable ramp systems.
- Cable Accessories — Cable ties, clips, and fasteners; cable covers, protectors, and conduit; cable reels, drums, and management solutions.
3.2 Condition at Pickup
All equipment is inspected and documented before rental. You will receive a condition report at the time of pickup or delivery. By accepting the equipment, you acknowledge that it is in good working order unless a discrepancy is noted in writing within 2 hours of receipt.
It is your responsibility to inspect all equipment upon receipt and report any pre-existing damage immediately to Cable Fleet.
4. Customer Responsibilities
During the rental period, you are solely responsible for:
- Using all rented equipment only for its intended, lawful purpose.
- Keeping equipment secure and protected from weather, theft, and unauthorized use.
- Not subletting, loaning, or otherwise transferring possession of the equipment to any third party.
- Not altering, modifying, repairing, or disassembling any equipment without prior written consent from Cable Fleet.
- Complying with all applicable federal, state, and local laws, codes, and regulations governing the use of the equipment.
- Ensuring that cable ramps and covers are used in accordance with their rated load capacity. Do not exceed manufacturer-specified weight limits.
- Protecting cables from excessive heat, sharp edges, vehicle damage, and moisture exposure beyond reasonable outdoor use.
- Returning all equipment in the same condition as received, ordinary wear excepted.
5. Prohibited Uses
The following uses are strictly prohibited and may result in immediate termination of the rental, forfeiture of the deposit, and/or additional charges:
- Using equipment in a manner that creates a safety hazard or risk of injury to persons or property.
- Using cable ramps in applications exceeding their rated weight capacity.
- Running cables under conditions likely to cause damage (e.g., unprotected outdoor exposure in harsh weather, over rough surfaces).
- Using equipment for any illegal purpose.
- Intentionally damaging, defacing, or modifying equipment.
- Removing, tampering with, or obscuring any identification labels, serial numbers, or asset tags on the equipment.
6. Fees, Payment & Deposits
6.1 Rental Fees
Rental rates are disclosed at the time of booking. All quoted rates are exclusive of applicable taxes unless stated otherwise. Cable Fleet reserves the right to change rental rates at any time; however, rates confirmed at booking will be honored for the agreed rental period.
6.2 Deposit
A refundable security deposit will be required at the time of booking or pickup. The deposit amount varies by equipment type and rental value. Deposits will be returned within 5–10 business days of equipment return, subject to inspection and any applicable deductions.
6.3 Late Fees
Equipment returned after the agreed return date/time will incur a late fee equivalent to the daily rental rate for each day (or portion thereof) beyond the scheduled return date, unless an extension has been approved in advance.
6.4 Damage & Loss Fees
You are financially responsible for any damage to or loss of equipment beyond normal wear and tear. Charges may include:
- Repair costs: Actual cost of repair or refurbishment.
- Replacement costs: Full replacement value of lost, stolen, or irreparably damaged equipment.
- Cleaning fees: A cleaning fee of no less than $25 may be charged for equipment returned in excessively dirty condition.
Cable Fleet will provide an itemized invoice for all assessed damage or loss charges.
6.5 Accepted Payment Methods
Cable Fleet accepts major credit cards, debit cards, and ACH bank transfer for business accounts. Payment is due at the time of booking unless a net-terms account has been established in writing.
7. Delivery & Return
- Delivery and pickup services may be available for an additional fee. Availability is subject to location and scheduling.
- You are responsible for ensuring that a designated authorized individual is present to receive or return equipment.
- Equipment must be reasonably clean and free of debris upon return.
- Cable Fleet will perform an inspection upon return. Any damage identified will be documented and you will be notified of applicable charges.
- If you are unable to return equipment on the scheduled date, you must contact Cable Fleet at (866) 578-7008 or contact@cablefleet.com as soon as possible.
8. Liability & Indemnification
8.1 Assumption of Risk
You assume all risk associated with the rental, transportation, storage, and use of Cable Fleet equipment. Cable Fleet is not liable for any injury, damage, or loss arising from the use or misuse of rented equipment.
8.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CABLE FLEET'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE TOTAL RENTAL FEES PAID BY YOU IN THE 30 DAYS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. CABLE FLEET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
8.3 Indemnification
You agree to defend, indemnify, and hold harmless Cable Fleet and its officers, employees, agents, and successors from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of any rented equipment; (b) your breach of this Agreement; or (c) any violation of applicable law by you or any third party using the equipment with your knowledge or permission.
9. Insurance
Cable Fleet strongly recommends that Customers obtain appropriate insurance coverage for rented equipment, including general liability and property/inland marine coverage. Cable Fleet does not provide insurance coverage on behalf of Customers. You are solely responsible for any uninsured losses, damages, or liabilities arising from the use of rented equipment.
10. Cancellations & Refunds
- Cancellations made 48 or more hours before the scheduled rental start will receive a full refund of any prepaid rental fees.
- Cancellations made less than 48 hours before the scheduled start may be subject to a cancellation fee equal to one day's rental rate.
- No-shows or cancellations after equipment has been dispatched for delivery will forfeit any delivery fees paid and may be subject to additional charges.
- Cable Fleet reserves the right to cancel any rental at any time due to equipment unavailability, safety concerns, or customer non-compliance with this Agreement. In such cases, a full refund of prepaid fees will be issued.
11. Default & Remedies
You will be considered in default under this Agreement if you:
- Fail to return equipment by the agreed return date without prior approval.
- Fail to make any payment when due.
- Misuse, abuse, or use the equipment in violation of this Agreement.
- Become insolvent, file for bankruptcy, or have a receiver appointed.
Upon default, Cable Fleet may, without notice, exercise any or all of the following remedies: terminate the rental, demand immediate return of all equipment, pursue legal action for unpaid fees and damages, and/or report equipment as stolen to law enforcement.
12. Governing Law & Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law principles.
Any dispute arising out of or relating to this Agreement shall be resolved first through good-faith negotiation. If the parties are unable to resolve the dispute within 30 days, either party may submit the dispute to binding arbitration in Worcester County, Massachusetts, pursuant to the rules of the American Arbitration Association, or pursue relief in a court of competent jurisdiction in Massachusetts.
The prevailing party in any such proceeding shall be entitled to recover reasonable attorneys' fees and costs.
13. Modifications to Terms
Cable Fleet reserves the right to update or modify these Terms of Service at any time. Notice of material changes will be provided via email to the address on file or posted on our website. Continued use of our rental services following notice of any change constitutes your acceptance of the updated Terms. The Terms applicable to an existing, active rental agreement will remain in effect until that rental period concludes.
14. Entire Agreement & Severability
This Agreement, together with your rental order and any addenda signed by both parties, constitutes the entire agreement between you and Cable Fleet regarding the subject matter herein and supersedes all prior or contemporaneous agreements, communications, and understandings.
If any provision of this Agreement is found invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
